Terms of Service


Hosted Content:

Any content placed on a PortalWebHosting.com site is subject to federal, state, and city laws. In the event a legal investigation is initiated by a law enforcement agency, PortalWebHosting.com will cooperate fully in providing all requested information. Sites that host pornographic content, other content in violation of copyright law, or any other material deemed inappropriate by PortalWebHosting.com, are prohibited. If PortalWebHosting.com determines that a site is in violation of this provision, the client's account will be deactivated immediately, the entire site will be deleted without notice, and no refunds will be given.

Bandwith Usage:

All PortalWebHosting.com accounts come with a specified amount of monthly transfers. In the event the client exceeds their allowed bandwidth, they will be notified and will have the option to upgrade to a plan with higher transfer limits.

Email Abuse:

Sending unsolicited email in large quantities through the PortalWebHosting.com network, commonly known as "spamming", is prohibited. If a violation of this provision is detected, PortalWebHosting.com reserves the right to terminate services to the client without notice or refund.

Bulk Mailing:

Sending large quantities of mail of similar content to over 500 recipients is not allowed on the PWH network as it may endanger the reputation of our mail servers. Customers may sign up for a VDS(Virtual Dedicated Server) or VPS (Virtual Private Server) if they are interested in sending out messages with more volume. Violation of our Bulk Mailing Policy may result in immediate termination of services without notice or refund.

Server Abuse:

Any attempt to undermine or cause harm to a server, or customer, of PortalWebHosting.com is strictly prohibited.

Chat Rooms:

We do not allow clients to install their own chat rooms, as they commonly consume excessive system resources, affecting other customers~R quality of service. We also do not allow IRC or IRC bots (such as eggdrop) to be operated on our servers.

Data Backup:

The control panels provided by PortalWebHosting.com include backup utilities that may be used to guard against loss of data. Each client is responsible for making their own backups on a regular basis. Regardless of the type of failure, PortalWebHosting.com will not be responsible for lost data, files, or web site pages.


All credit card accounts are billed automatically on a monthly basis. If the credit card provided by the client does not have sufficient credit for the monthly charge to be applied, a courtesy notice will be emailed requesting a new card number or different form of payment. Any accounts over 15 days past due will be suspended until payment is made, and will be subject to a $10 reactivation fee.

Account Cancellation:

We offer a full 30-day money-back guarantee. If for any reason you are not fully satisfied with your account, notify us within 30 days of your order and you will receive a full refund to your credit card. However, please note that domain registration is NON-REFUNDABLE. After the 30 day period, you may cancel your account at any time, though all payments already made are non-refundable. To prevent abuse of this guarantee, only one 30-day guarantee per customer is allowed.

Limitation of Liability:

PortalWebHosting.com uses high-quality components in our web-hosting servers to minimize the possibility of failures. Nevertheless, hardware and software failures do happen, and are beyond the control of PortalWebHosting.com. While we do take precautions to minimize downtime in the event of a failure, PortalWebHosting.com will not be held responsible for any damages, consequential or incidental, resulting from software failures, hardware failures, or the deletion or corruption of files or websites on a PortalWebHosting.com server.

Refusal of Service:

PortalWebHosting.com reserves the right to refuse, cancel, or suspend service at our sole discretion.

Reserved Rights:

In addition to the items mentioned above, PortalWebHosting.com reserves additional rights as a part of this agreement. PortalWebHosting.com may choose to remove any site from the system without reason if it is decided to be in the best interest of the majority of it's customers, provided that any unused portion of the clients' payment for services is refunded. We will not refund any applicable setup or reactivation fees. Furthermore, if for any reason a lawsuit is brought against PortalWebHosting.com, the laws and regulations of the State of South Dakota, County of Brown, and city of Aberdeen, will be upheld.


We charge customers on a monthly, quarterly, semi-annually, or annually basis for hosting services. There are no contracts with Portal Web Hosting. We believe in earning your business every billing term and bill for the service on the term that you choose.

You are billed immediately at sign up and then again approximately 30, 90, 180, or 365 days from your sign up date depending on the billing term you choose. For example: For monthly billing if you sign up on the 8th of the month, you will be billed again approximately 30 days later in the next month.

We automatically charge your credit card on file each billing term. You may be sent a subscription ending notification email. You do not need to act on this email if you have a valid credit card on file with us. Your card will be charged automatically every billing term for your hosting fees. The subscription reminders are sent as a courtesy for your records.

If you do not want your credit card charged automatically you may request to make your payment by PayPal or personal check, but it is your responsibility to make payment on time, every month in order to avoid disruption of your site. You must email us at billing@portalwebhosting.com if you do not wish to be automatically billed.

After 30 days, we are not responsible for items on your subscription that may have been billed incorrectly or you feel may be errors, after the subscription in question has been issued. No retroactive billing credits are allowable unless documentation is supplied to us in writing of the agreed upon amount. We will then investigate the issue and if it is our oversight - we will gladly fix our error.

All active subscriptions for hosting accounts are due upon receipt unless otherwise arranged with our billing department.

Cancellations must be in writing to billing@portalwebhosting.com and must be presented 5 business days before subscription renews. Please refer to your domain name for easy reference.

There are no partial or full refunds for cancelled hosting.

We make every attempt to notify you by email if your monthly invoice is not paid before your site is automatically disabled. It is the customer's responsibility to update their contact information, including email address, phone number and credit card details so we can make contact with you. We are not responsible for correspondences that do not reach you due to bad email addresses. Accounts that are not paid 14 days after the invoice due date are subject to interruption of service.

We are not responsible for:

  • failed applications of software
  • software issues on your computer
  • failures of third party software such as FTP or email clients
  • local connectivity issues caused by your internet service provider
  • search engine ranking of your site in any search engine
  • customers failure to understand or use application software.
